Membership Terms & Conditions

1. ACCEPTANCE OF TERMS

The Fabric Folk pop-up sales are part of a service to encourage the reuse of waste and surplus materials, providing low-cost materials and various workshops (referred to hereafter as "the Service") subject to the following Terms of Use ("Terms"), which may be updated by The Fabric Folk from time to time. The Fabric Folk will provide notice of significant changes to the Terms via email and social media. You can review the most current version of the Terms at Terms of Service. By signing up as a member, you are agreeing to comply with these Terms.

2. ELIGIBILITY

Unless otherwise specified by The Fabric Folk in writing, the Service is only available to individuals who are at least 18 years old. At present, The Service is only available to those based in the UK. The FABRIC FOLK CIC is located in Hertford, Hertfordshire. You do not need to be a Hertfordshire resident to use the service.

3. PRIVACY AND INFORMATION DISCLOSURE

The Fabric Folk has established a Privacy Policy to explain to users how their information is collected and used, located here: Privacy Policy. Your use of the The Fabric Folk website or the Service signifies acknowledgement of and agreement to our Privacy Policy. 

As a member of The Fabric Folk, you further acknowledge and agree to provide feedback and relevant data required on the Service through methods including but not limited to questionnaires. The data required of members may include the types of materials collected, the projects completed, the method of transport to collect materials, feedback on the project and the amount of surplus material.

As a member of The Fabric Folk, you further acknowledge and agree to receive emails relating to the project. These emails will be used for purposes including but not limited to updates to the Terms, updates to The Service, upcoming workshops, new projects and reminders to provide feedback and complete questionnaires. If you do not have an email address, you agree to supply us with at least one other form of correspondence.

4. MATERIAL USE AND MONITORING

You agree that the use of the Service is entirely at your own risk. The Service is provided on an “as is” or “as available” basis, without warranties or guarantees of any kind.

You agree to not sell on the provided materials in their unaltered state for commercial gains. If unused, these materials should be returned to The Fabric Folk so they can be supplied to others.

You agree to document all projects completed and provide feedback. You may sell products completed from The Fabric Folk materials for commercial gains, providing they do not infringe on the Service Terms.

5. LIMITATIONS OF LIABILITY

Under no circumstances shall The Fabric Folk be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if The Fabric Folk has been advised of the possibility of such damages), resulting from any aspect of your use of the The Fabric Folk website or the Service, whether these damages arise from use or misuse of the The Fabric Folk website or the Service, from the inability to use the The Fabric Folk website or the Service, or the interruption, suspension, modification, alteration, or termination of the The Fabric Folk website or the Service. These limitations shall apply to the fullest extent permitted by law.

6. INDEMNITY

You agree to indemnify, defend and hold harmless The Fabric Folk, its affiliates, licensors, officers, directors, employees, consultants, licensees and agents from and against any and all claims, demands, liability, damages and/or costs (including, but not limited to, investigation and legal fees) arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the The Fabric Folk Website or the Service, or the use by any other person accessing the The Fabric Folk Website or the Service using your Customer account, Membership and/or your Personal Information.

7. INTELLECTUAL PROPERTY

Certain of the names, logos, and other materials displayed in the Service constitute trademarks or intellectual property of The Fabric Folk or other entities. Ownership of all such trademarks and other intellectual property remains with The Fabric Folk or those other entities.

8. TERMINATION OF MEMBERSHIP

To terminate your Fabric Folk membership, please contact us and allow five (5) working days for us to process your membership being terminated. You may not terminate this Agreement prior to the end of the Commitment Term, and any such termination shall constitute a breach of this Agreement.

You agree that The Fabric Folk, in its sole discretion, has the right to delete or deactivate your membership, block your email or IP address or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, if The Fabric Folk believes that you have acted inconsistently with the Terms. Further, you agree that The Fabric Folk shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use the Service after said termination. Sections 3-7 shall survive termination of these Terms.
